Although the arrest warrant for Duterte, former president of the Philippines, for crimes against humanity was issued by the International Criminal Court (ICC) and the Red Notice was issued by Interpol, enforcement still requires the consent of a sovereign state. This is an exercise of sovereign power, not a sovereign obligation.
As soon as Duterte returned to his country from Hong Kong, he was arrested and sent to an air force base, from where he was directly transported by a charter flight to The Hague for trial.
Duterte could only return home to face trial, gambling that doing so might allow his daughter, vice president incumbent, and family’s political influence to persist or even maintain power. If he chooses not to return, his political stronghold and influence will completely collapse. His trip to Hong Kong may also suggest that negotiations with China have failed.
This move by the Philippines also aligns with its previous request for international arbitration over the South China Sea dispute, reinforcing the country’s consistent adherence to international law. Of course, the prospect of securing reciprocal benefits in the future is also a factor.

菲律賓總統小馬可仕昨天深夜證實，菲律賓政府已將前總統杜特蒂押送海牙國際刑事法院，並強調這是為了履行菲律賓對國際刑警組織（INTERPOL）的義務。

小馬可仕（Ferdinand Marcos Jr.）深夜在馬拉坎南宮召開記者會說，押送杜特蒂（Rodrigo Duterte）前往海牙的專機，已於11日晚上11時03分從馬尼拉起飛，杜特蒂將因擔任總統任內發動的血腥掃毒戰，在國際刑事法院接受危害人類罪名審判。

他說明，INTERPOL馬尼拉站收到來自國際刑事法院針對杜特蒂的逮捕令正本，由司法部總檢察長在杜特蒂返抵國門時送達。

小馬可仕說，INTERPOL尋求菲律賓政府的協助，而菲律賓作為會員國有義務配合，這是國際社會對菲律賓作為民主國家和國際社會一員的期望。

他補充，菲律賓若不配合INTERPOL的請求，未來菲律賓需要追捕在外逃犯罪嫌疑人時，INTERPOL也將不會協助菲律賓。

面對杜特蒂陣營提出的「非法拘捕」質疑，小馬可仕回應，逮捕杜特蒂的行動符合法律程序，經得起檢驗。

被問及這是否與今年5月即將登場的期中選舉有關？小馬可仕答稱，國際刑事法院開始調查杜特蒂掃毒戰時，他還不是菲律賓總統，與此案無關。

現年79歲的杜特蒂最近前往香港為自己支持的候選人造勢，昨天上午返抵馬尼拉國際機場時，被菲律賓警方逮捕。

杜特蒂於2016年至2022年擔任菲律賓總統時發動掃毒戰，數以千計可疑吸毒者死於街頭，人權人士及死者家屬於2018年向國際刑事法院控告杜特蒂放任警察進行「法外處決」。
