They claim that Ms. Hsiao Bi-kim, the ruling DPP's vice-presidential candidate for the 2024 Presidential Campaign, may possibly not be qualified as a candidate under Article 20 of the Presidential and Vice Presidential Election and Recall Act. The key issue is whether Ms. Hsiao, as a half breed daughter of Taiwanese father and American mother, had once renounced her ROC nationality. This is a matter of fact.
The same scrutiny applies to Ms. Cynthia Wu, the TPP's vice-presidential candidate for the 2024 Presidential Campaign. It is despicable for the media and politicos to criticize the two candidates before verifying the truth.
But there are two kinds of ROC nationals: one consists of those who are born and live in Taiwan, who have household registration then have complete citizenship; the other includes those who live outside Taiwan, without household registration then have no citizenship. Which kind of ROC nationality does Hsiao have?

〈總統副總統選舉罷免法〉　第 20 條

在中華民國自由地區繼續居住六個月以上且曾設籍十五年以上之選舉人，年滿四十歲，得申請登記為總統、副總統候選人。

回復中華民國國籍、因歸化取得中華民國國籍、大陸地區人民或香港、澳門居民經許可進入臺灣地區者，不得登記為總統、副總統候選人。

Presidential and Vice Presidential Election and Recall Act　Article 20

An elector who has lived in the free regions of the ROC for not less than six consecutive months, has set his/her domicile in the ROC for not less than fifteen years,and has completed his/her fortieth year of age may apply for being registered as the candidate for President or Vice President.
Anyone who restores the ROC nationality or acquires the ROC nationality by naturalization or the people in the People’s Republic of China or the residents in Hong Kong and Macao who are permitted to enter Taiwan may not be registered as the candidate for President or Vice President.

「經過事實查核中心查證，
第一，美國聯邦政府政府公報《聯邦公報》網站，在2002年7月22日公布放棄美國國籍名單有「Hsiao Bi-Khim」，中間名為Louise。蕭美琴英文姓名使用台語羅馬拼音「Hsiao Bi-Khim」，可判斷美國聯邦公報網站的Hsiao Bi-Khim應為蕭美琴。
第二、傳言引用2000年的新聞，此報導是時任總統府顧問的蕭美琴說明未放棄美國籍的原因，此新聞並不是近況。
第三、2002年3月14日媒體報導，顯示2002年蕭美琴宣誓就任立委，並取得身分證，當時蕭已向美國在台協會申請放棄美國籍。」

但現在的問題點是回復與歸化。前者是放棄又再次申請，後者是本來不是後來才以外國人身分申請。

蕭美琴書面聲明說明國籍立場    華視新聞 20221130

　　總統府顧問蕭美琴，則是在今晚發表了書面聲明，澄清外界質疑她，因為具有美國國籍，而損及對國家忠誠度。同時對於各界對她的關懷及關心，再三表示感謝。

　　這封刻意迴避總統府字樣，單純以蕭美琴個人身分發表的聲明書中，首先針對蕭美琴不願意放棄美國籍的原因做出解釋。

　　蕭美琴說，經過多次詢問各國代表處，放棄美國籍，只有華僑護照，就無法取得包括日本、泰國、美國、及許多歐洲申根國家的簽證。美國在台協會官員也明白告知，放棄美國籍，又沒有台灣身份證字號以及永久居留權的護照，只是一份【旅行證件】。美國法律會把她當作【無國籍人】，這樣的身分，可能連在台灣居留都會有問題，因此讓她無法放棄美國籍。

　　蕭美琴認為，這是過去歷史因素所造成的一些不合理規定，以及相關手續的繁雜，她現在深深體會，但是一般人都不能夠理解。
