當總長成為四星上將，部長就不一定要具軍職背景，文人部長制度亦可建立

While I am not knowledgeable enough to determine whether a three-star or four-star general is more suitable for the highest-ranking military officer position, it is important to note that the requirements are stipulated by law, and not by President Tsai Ing-wen's personal preference, with the exception of the Minister of Defense. During her seven years in office, President Tsai has appointed onlt three ministers of defense comparing to the case of  the Chief of the General Staff.
The ruling DPP, which holds the majority in the Legislative Yuan, could revise the law in a day if it deems it impractical.
Nevertheless, President Tsai's stance towards civilian and military officials remains puzzling, given her inconsistent treatment of these individuals.
According to the article, the Chief of General Staff was downgraded to a three-star general, which imposes an age limit on retirement. As a result, President Tsai has had seven Chiefs of General Staff in seven years, meaning that each one served for less than one year. Everyone knows that this is not the right thing.
On the other hand, concerning officials such as the Premier, ministers, and political commissioners, even if they are clearly unsuitable for their positions, President Tsai remains rooted. It is not sufficient to argue that ministers fall under the jurisdiction of the Premier, not the President. The former is also appointed by the latter.
Why does such a differential treatment occur in the Tsai administration?

對於制服組最高階軍官應該是一級上將或是二級上將，我並無足夠的常識去分辨。雖說這是法律規定，但若法律規定不適用了，作為國會過半的執政黨，應該可以很輕易的改正。
蔡英文總統對於文官與五官兩種態度令人不解。照文章的敘述，參謀總長因為降編為二級上將，所以有退役的年齡限制，因此，蔡總統七年來用了七位總長，等於一位總長上任僅僅一年。任何人都知道，這樣是不對的。
相對的，對於包括行政院長、部長、政務委員等官員，即便明顯不適任了，蔡總統卻是不動如山。這不是部長屬於行政院長管轄就可以卸除責任。因為，行政院長也是總統任命。
為何在蔡政府中，會出現如此的差別待遇？

參謀總長陳寶餘上將去年5月1日屆滿64歲，蔡英文總統核定延長服役1年，將於本月底屆期卸任，不管接任人選為何人，將是蔡總統任內第7位擔任總長的人選，平均1年就換總長，更替不可謂不大。

然而，總長異動如此頻繁，怪不得蔡總統，自總長職位由一級上將（四星上將）降編為二級上將後，因有64歲屆齡退役的限制，能做滿2年任期的總長只有李喜明，最短的只做了5個月。

自2013年總長降編為二級上將起，歷經8任總長，包括嚴明、高廣圻、嚴德發、邱國正、李喜明、沈一鳴、黃曙光、陳寶餘等，另劉志斌曾代理半個月。這8位就任時平均年齡為62歲餘，因而都做不滿2年，僅李喜明升任時是61歲10個月，因此做了2年2個月，也是任期最長的。

至於其他7位總長，沈一鳴搭乘直升機因公殉職，任職6個月又2天；嚴明與高廣圻直接升任國防部長，其他5位總長，除現任陳寶餘外，皆屆齡退休，8人中任期最短的邱國正，僅做5個月。除了嚴明與高廣圻，嚴德發與邱國正也做了國防部長，但都是退役繞了一圈後才升任部長。

現任總長陳寶餘又是個新例，陳去年5月1日屆滿64歲，但陳只做10個月，於是依去年元月修訂的《陸海空軍軍官士官服役條例》第6條，由蔡總統核定延長服役1年；陳是首位總長屆齡延任者，即便如此，本月底卸任後還是做不到2年。

8位二星上將總長，蔡總統任內便占了6位，除沈一鳴殉職，陳寶餘延任1年，其餘4位都是64歲屆齡退役。待5月1日新派任總長後，蔡總統任內共任命7位總長；與前幾位民選總統相較，馬總統任用4位總長，陳水扁也是4位。

可能是總長受年齡限制，異動過於頻繁，蔡總統任用的國防部長不常更換，目前僅用3人，包括馮世寬、嚴德發與邱國正；若無意外，邱國正應會做到明年520蔡總統卸任。

當初總長從一級上將降編為二級上將，考量很多因素，不過現在時空有所不同，一是兩岸軍事情勢嚴峻，台海安全已是烏克蘭之外，最受國際關注的焦點；再者，明年義務役期將恢復為1年，兵源會逐年增加，預料現在總兵力21.5萬人，未來遲早要調升。而總長負責戰時指揮三軍聯合作戰，以當前台海嚴峻情勢而言，不宜如走馬燈般，經常換人。

為下任總統著想，蔡政府應考慮修法恢復總長為一級上將，適用條件為明年5月新任總統任命的首位總長。當總長成為四星上將，部長就不一定要具軍職背景，文人部長制度亦可建立。
