美國公民及移民服務局(USCIS)10月2日)發布政策指南,明文強調:凡是申請移民的共產黨員或其他極權主義政黨的黨員或與之相關的成員,都不會獲得受理。
理由是:其加入共產黨或極權政黨成為黨員或附屬成員,與歸化美國時效忠美國的宣誓衝突。
加入共產黨的宣誓中,包括「為共產主義奮鬥終身,隨時准備為黨和人民犧牲一切,永不叛黨。」而歸化美國則要宣誓support and defend the Constitution and laws of the United States.
華人都誤以為宣誓是一件小事情,甚至可以欺瞞。理解一下Jakiw

Policy Guidance Regarding Inadmissibility Based on Membership in a Totalitarian
Party USCIS 20201002
On Oct. 2, USCIS issued policy guidance in the USCIS Policy Manual to address inadmissibility
based on membership in or affiliation with
the Communist Party or any other totalitarian party.
Membership in or affiliation with the Communist
Party or any other totalitarian party is inconsistent
and incompatible with the Naturalization Oath of Allegiance to the United
States of America, which includes pledging to “support
and defend the Constitution and laws of the United States.”
The new policy manual section provides guidance on how to adjudicate inadmissibility
due to membership in the Communist Party or any other totalitarian party in the
context of adjustment of status applications.
In general, unless otherwise exempt, any intending immigrant who is a member
or affiliate of the Communist Party or any other totalitarian party (or subdivision
or affiliate), domestic or foreign, is inadmissible
to the United States. This addition
to the policy manual will help officers adjudicate this inadmissibility ground consistent
with federal law.

SUBJECT: Inadmissibility Based on Membership in a Totalitarian Party
Purpose
U.S. Citizenship and Immigration Services (USCIS) is issuing policy
guidance in the USCIS Policy Manual to address inadmissibility based on
membership in or affiliation with the Communist or any other totalitarian
party.
Background
The inadmissibility ground for membership in or affiliation with the
Communist or any other totalitarian party[1]
is part of a broader set of laws passed by Congress
to address threats to the safety and security of the United States.[2]
In general, unless otherwise exempt, any
immigrant who is or has been a member of or affiliated with the Communist or
any other totalitarian party (or subdivision or affiliate), domestic or
foreign, is inadmissible to the United States. This ground of inadmissibility only applies to
aliens seeking immigrant status, such as aliens inside the United States
applying to adjust status to that of a lawful permanent resident. This
guidance, contained in Volume 8 of the Policy Manual, is controlling and
supersedes any related prior guidance on the topic.
