政府將訂立《禁止蒙面規例》(《規例》),以禁止《公安條例》(第245章)所規範的公眾集會及遊行,以及非法集結、未經批准集結和暴動中使用蒙面物品。違例者最高可被罰款25,000元及監禁一年。
The Government will put in
place the Prohibition on Face Covering Regulation to ban the use of facial
covering in public meetings and processions regulated under the Public Order
Ordinance (Cap. 245) and unlawful and unauthorised assemblies as well as riots.
Offenders will be liable to a maximum fine of $25,000 and imprisonment for one
year.
行政長官林鄭月娥今日(十月四日)下午主持記者會時宣布有關立法措施。
The legislative measure was announced at a
press conference hosted by the Chief Executive, Mrs Carrie Lam, this afternoon
(October 4).
《規例》今日在憲報刊登,並將於明日(十月五日)生效。
The Regulation is published in
the Gazette today (October 4) for commencement tomorrow (October 5).
《規例》會讓有合理辯解使用蒙面物品而違反禁令的人提出免責辯護。這些合理辯解包括但不只限於:先前已存在的醫學或健康理由、宗教理由、或該人從事專業或受僱工作,並在進行與該專業或受僱工作有關的活動時使用蒙面物品以保障自身安全。
It is a defence for a person
charged with an offence of violating the prohibition to establish that he had
reasonable excuse for using a facial covering. These reasonable excuses
include, but are not limited to, pre-existing medical or health reasons,
religious reasons and a person being engaged in a profession or employment and
using the face covering for his physical safety while performing an activity
connected with his profession or employment.
此外,如警務人員在任何公眾地方發現任何人使用蒙面物品,並合理地相信該蒙面物品相當可能阻止識辨該人身分,該名警務人員可截停該人,並要求該人除去有關蒙面物品,以核實其身分。沒有遵從有關要求的人最高可被罰款10,000元及監禁六個月。
Apart from this, where a
police officer finds in any public place any person who is using a facial
covering that the police officer reasonably believes is likely to prevent
identification, the police officer may stop and require the person in the
public place to remove the facial covering for verifying the identity of the
person. The maximum penalty for failure to comply is a fine of $10,000 and
imprisonment for six months.
此禁令是根據《緊急情況規例條例》(第241章)因應危害公共安全所訂立的《規例》。
The prohibition is effected as
a regulation under the Emergency Regulations Ordinance (Cap. 241) on public
danger grounds.
政府發言人表示,自六月九日,香港有超過400宗由《逃犯條例》(第503章)修訂建議引發的公眾活動,當中有相當多的公眾活動以暴力事件告終。發言人補充指激進及蒙面的示威者嚴重破壞公眾安寧,對社會造成廣泛和即時危險。
Since June 9, more than 400
public order events arising from the proposed amendments to the Fugitive
Offenders Ordinance (Cap. 503) have been staged with a significant number of
events ending up in outbreaks of violence, a Government spokesperson said,
adding that the acts of radical and masked protesters had seriously breached
public peace and posed widespread and imminent danger to the community.
發言人說:「在九月二十九日及十月一日,蒙面示威者使用的暴力極端激進,大肆對人和財產投擲汽油彈、嚴重襲擊警務人員、警車及警署,並大規模蓄意破壞港鐵車站和政府合署等。香港的整體公共安全受到嚴重威脅,香港有迫切需要恢復社會的正常運作。」
"On September 29 and
October 1, the use of violence by masked protesters was extremely radical with
the wide use of petrol bombs against life and property; vicious attacks on
police officers, vehicles and police stations; and heavy vandalism of MTR
stations and government offices, etc. The whole city is in danger and there is
a pressing need to restore the normal functions of the community," the
spokesperson said.
「禁止蒙面的行為,有迫切立法需要,以協助警方的刑事調查及搜證,以及阻嚇暴力和違法行為。鑑於蒙面示威者在近期公眾活動中的違法和暴力行為日益升級,有必要及相稱地訂立《規例》以保障公共秩序和安全。」完
"The prohibition on
facial covering is urgently needed for police investigation and collection of
evidence, and for deterring violent and illegal behaviour. The prohibition is
no more than what is necessary and proportionate to protect public order and
safety in light of the escalating illegal and violent acts of the masked
protesters at recent public order events."
