6月29日中國財政部公佈〈亞洲基礎設施投資銀行協定〉條約文本。第3.3條「不享有主權或無法對自身國際關係行為負責的申請方,應由對其國際關係行為負責的銀行成員同意或代其向銀行提出加入申請。」[1] 讓台灣住民難以接受。
就國際法而言,非擁有國格(次於國家)的領土,其當局理所當然的被看成無法為自己的國防、外交,甚至於財政等事項負責,僅能實施內部自治(autonomy)。為此,其上必然有一「管理國」(administering power)[2]
實施監護。若此領土當局要加入國際組織,必須由「管理國」代為引介或申請。如〈聯合國教科文組織憲章〉(第2.2條)[3]、〈國際衛生組織憲章〉[4](第8條),甚至於〈亞洲開發銀行憲章〉(第2.3條)[5] 也都有幾乎一樣的規定。準此,〈亞投行協定〉的規定並不新鮮。
陸委會表示:〈亞投行協定〉在第3.2條設立了側門「國際復興開發銀行和亞洲開發銀行成員,如未能依照第五十八條規定加入銀行,可依照第二十八條規定經理事會特別多數投票同意後,遵照銀行決定的加入條件成為銀行成員。」因而判斷:台灣治理當局有可能以亞銀會員身分加入亞投行。
不過,在亞銀會員名單中,台灣是以「逗點後不空一格」的「合成符號」Taipei,China呈現——似中非中,似台非台;加入日期仍為創始的1966年[6]。它雖被翻譯為「中國台北」[7],但亞銀僅以英文為準,官方名稱仍為Taipei,China。我方每年對亞銀會員名稱可行禮如儀的提出抗議,但在亞投行,中、英、法文皆相同作準;加上中國佔股26%,等於具有否決權,會籍問題,必由中國說了算!
〈協定〉一公佈,證實了馬政府在不明就裡前躁進盲動,讓北京順勢設下陷阱。賴怡忠教授指謫:真正的錯誤是馬政府向國台辦(國內意義),而不是向中國財政部(國際組織意義)遞交意願書。
馬政府接受〈亞投行協定〉第3.3條規定,等於默示「中國是台灣的管理國」的地位。此舉完全違反〈舊金山對日和約〉對台澎地位的設計。美國是代表聯合國的和約主辦國,如果台澎之上該有管理國,必然非美國莫屬。馬的一封傳真無異邊放暗箭邊跳船。管理國,怎能不防範馬的躁進後果。

Health Assembly should be qualified by their technical competence in the field
of health and should be chosen from the native population. The nature and

[5] Article 2.3: In the case of associate members of the United
Nations Economic Commission for Asia and the Far East which are not responsible
for the conduct of their international relations, application for membership in
the Bank shall be presented by the member of the Bank responsible for the
international relations of the applicant and accompanied by an undertaking by
such member that, until the applicant itself assumes such responsibility, the
member shall be responsible for all obligations that may be incurred by the
applicant by reason of admission to membership in the Bank and enjoyment of the
benefits of such membership. "Country" as used in this Agreement shall
include a territory which is an associate member of the United Nations Economic
