VESTING TITLE TO JAPEANESE PROPERTY WITHIN
KOREA
日本在韓國財產歸屬
Section Ⅰ. Ordinance Number 31 having never been
published in the Official Gazette hereby declared null and void as though it
were never issued.
第一條 第31號指令從未刊登於官方公報，茲公布其無效，等同於未曾發佈。
Section Ⅱ. The title to all gold, silver, platinum,
currency, securities accounts in financial institutions, credits, valuable
papers, and any other property located within the jurisdiction of this Command,
of any type and description, and the proceeds thereof, owned or controlled,
directly or indirectly, in whole or part, on or since 9 August 1945, by the
Government of Japan, or any agency thereof, or by any of its nationals,
corporations, societies, associations, or any other organization of such
government or incorporated or regulated by it is hereby vested in the Military
Government of Korea as of 25 September 1945, and all such property is owned by
the Military Government of Korea. It is
illegal for any person without the authority of the Military Government of
Korea, to enter upon or take possession of any such property, remove any part
of such property, or injure or impair the value or utility of any such property.
第二條 所有位於本司令部管轄之下，由日本政府或其機構，或日本國民、企業、社團、協會，或該政府所有、合併、控管之其他任何組織，於1945年8月9日當日或其後，所直接或間接、全部或部分擁有或掌控之金、銀、白金、通貨、金融機構之證券帳戶、存款、有價證券及其他財產，無論其型態與記載、及收益如何，自1945年9月25日起全數歸於韓國軍政府之下且由其擁有。若無韓國軍政府之允許，任何人侵占或擁有任何上述財產、移轉前述財產之任何部分、或者破壞或減損任何前述財產之價值或效用者，皆視為非法。
Section Ⅲ. All custodians, curators, officials, banks,
trust companies and all other individuals, organizations or associations having
possession, custody, or control of property vested in the Military Government
of Korea by Section Ⅱ of this ordinance are required:
第三條 所有第二條所述應歸於韓國軍政府下之財產之所曾擁有、保管或控制之保管者、監護人、幹部、銀行、信託公司與所有其他個人、組織或協會，必須：
a.
(1) To hold the same, subject to the
directions of the Military Governor, and pending such direction not to transfer
or otherwise dispose of the same.
遵從軍事總督之指令，維持財產現狀，並在軍事總督指示之前不得移轉或以其他方式處分該財產。
(2) To preserve, maintain and safeguard
and to prevent any action which will impair the value or utility of such
property.
保存、維修與保護該財產，並避免減損該財產價值或效用之行為。
(3) To maintain accurate records and
accounts.
維持正確的資料與帳戶
b. When and as directed by the Military Governor
當軍事總督下達指示時，遵從其指示…
(1)
File reports furnishing such data as may be required with respect to
such property and all receipts and expenditures in connection therewith on and
after 9 August 1945
提交1945年8月9日當日與其後與該財產有關之資料及所有相關收支文件。
(2)
Deliver custody and control of such property and all books records and
accounts; and
交付該財產及所有書面資料與帳戶之保管與掌控，以及
(3)
Account for the property and all income and proceeds.
負責說明該財產及其所有收入與獲利。
Section Ⅳ. Any person violating the provisions of this
ordinance or of any license or order issued thereunder, shall, upon conviction
by a Military Occupation Court, suffer such punishment as the court shall
determine.
第四條 任何人若違反本指令條款，或本指令下之任何許可或命令，必須接受佔領軍事法庭判決，並依其判決受懲。
Section Ⅴ. This ordinance is effective upon publication
in the Official Gazette.
第五條 本指令自公布起生效。
