UN OHCHR：亂射民航機，相當於戰爭罪

至今，馬航受害者家屬與調查人仍很難前往失事地點，這是引發眾怒的導火線。

OHCHR 提出「事實上相當戰爭罪」，這是先聲。它的意思是：國際公訴罪（訴之於國際法庭）、追溯無限期，及可能以團體或指揮者個人的財產充當賠償（以凍結政府或個人境外資產的面貌為之）。

不要以為追溯不到，越是大咖、越殘暴，就越有必要將錢財藏在外國（特別是要藏在法治習慣的西方國家，然後出國度假、回國橫斂）。

否則，軍頭拼生拼死不是為錢，為啥？

ウクライナ東部でマレーシア航空の旅客機が撃墜された事件について国連人権高等弁務官事務所は２８日、「戦争犯罪に当たる」として、事件の真相究明に向けた捜査を急ぐよう求めました。

国連人権高等弁務官事務所は２８日、ジュネーブでウクライナ政府と親ロシア派の武装集団が激しい戦闘を続けているウクライナ東部の人権侵害の状況などについて記者会見を開きました。

はじめにマレーシア航空の旅客機が撃墜された事件について、ピレイ人権高等弁務官の声明が読み上げられ、「国際法の侵害で、事実上、戦争犯罪に当たる。早急に独立した機関による公明正大な捜査が行われなければならない」と呼びかけました。

また、人権高等弁務官事務所は報告書を発表し、ウクライナでの戦闘で、ことし４月から今月２６日までに１１２９人が死亡したことを明らかにしました。

さらに戦闘は、戦車やミサイルなど、より強力な装備で攻撃し合うようになっており、今後、犠牲者がさらに増えるおそれもあると指摘しました。

そのうえで、親ロシア派が支配する地域では法秩序が崩壊し、処刑が行われている疑いもあるとして現地の人権状況の悪化に懸念を示しました。

28 July 2014 – The shooting down of a Malaysian Airlines plane over eastern Ukraine may amount to a war crime, the United Nations High Commissioner for Human Rights today said today, releasing a new report that details a total breakdown of law and order and a reign of fear and terror inflicted by armed groups in the area.

“I would like to stress to all those involved in the conflict, including foreign fighters, that every effort will be made to ensure that anyone committing serious violations of international law, including war crimes, will be brought to justice, no matter who they are,” Navi Pillay said.  “I urge all sides to bring to an end the rule of the gun and restore respect for the rule of law and human rights.”

The High Commissioner made the comments while issuing a new report by the UN Human Rights Monitoring Mission deployed to Ukraine in mid-March, calling for greater care to prevent more civilian casualties.

The report, which covers the period from 8 June to 15 July, does not officially cover the 17 July downing of the plane. However, Mr. Pillay used the launch of the report to call for a “prompt, thorough, effective, independent and impartial investigation.”
